General Terms and Conditions
This translation is provided for convenience. Only the German version is legally binding.
1. Scope
These General Terms and Conditions (Terms) apply to all analysis orders placed by customers on the website herba-analytica.ch with Herbavita-Swiss GmbH, Christoph Merian-Ring 23, 4153 Reinach BL, Switzerland ("Herbavita-Swiss"). Deviating terms of the customer only apply if Herbavita-Swiss agrees to them in writing.
2. Services
Herbavita-Swiss performs the laboratory analyses described on the website (e.g. cannabinoids, heavy metals, mycotoxins, pesticides). Scope and method follow from the service description at the time of the order.
3. Order and conclusion of contract
The customer selects the desired analyses in the cart and submits the order with contact and delivery details. This constitutes a binding offer. The contract is concluded as soon as Herbavita-Swiss confirms the order with an order number.
The customer may cancel the order free of charge as long as the sample has not yet arrived at the lab; payments already made are refunded. Once the sample has been received, the order is binding and can no longer be cancelled.
4. Prices
The prices shown on the website in Swiss francs (CHF) at the time of the order apply. The order amount is calculated from the current price list when the order is submitted; amounts shown in the cart are not authoritative. Errors excepted.
5. Payment
Analyses are provided against prepayment. The customer pays by TWINT or bank transfer using the Swiss QR-bill or IBAN. The sample kit is shipped once payment has been received. If payment is not received within a reasonable period, Herbavita-Swiss may cancel the order.
6. Sample kit and sample submission
After payment, the customer receives a sample kit by post containing a sample container, an order form and a return envelope. The customer fills in 1–2 g of sample material, seals the container and sends the sample to the lab together with the order form.
The customer is responsible for shipping, packaging and the condition of the sample, and ensures that possessing and shipping the sample is lawful. Herbavita-Swiss is not liable for samples that are lost, damaged or seized in transit.
7. Turnaround time
The analysis is usually completed within 2–3 working days after the sample arrives at the lab. This is a guideline and not binding. Herbavita-Swiss is not liable for delays caused by force majeure or other unforeseeable circumstances.
8. Results and analysis report
The analysis report is made available in the customer’s online account on herba-analytica.ch. Orders are linked to the account via the email address given with the order.
Results apply exclusively to the submitted sample in the condition in which it was received by the lab. No conclusions may be drawn about other samples, batches or products.
Reports belong to the customer, who must not alter them or reproduce them in a falsified form. If Herbavita-Swiss later discovers an error, it will inform the customer and provide a corrected report.
9. Archiving
Analysis results and the underlying raw data are archived for ten years. Retained samples are kept for at least three months.
10. Liability
Herbavita-Swiss performs its services with due care. To the extent permitted by law, all liability is excluded, in particular for slight negligence, indirect and consequential damage, loss of profit, and decisions taken by the customer or third parties on the basis of the analysis results. Liability for intent and gross negligence remains reserved.
11. Confidentiality and data protection
Herbavita-Swiss treats orders, samples and analysis results confidentially unless disclosure is required by law. The processing of personal data is described in the Privacy Policy.
12. Intellectual property
Analytical methods developed by Herbavita-Swiss remain its intellectual property. Texts and images on this website are protected by copyright and may not be used without written permission.
13. Changes
Herbavita-Swiss may change these Terms at any time. The version published at the time of the order applies to that order.
14. Governing law and place of jurisdiction
These Terms are governed exclusively by Swiss law, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). The place of jurisdiction is the registered office of Herbavita-Swiss GmbH in Reinach BL. Mandatory statutory places of jurisdiction, in particular for consumers, remain reserved.
